各县(市)、区人民政府,市人民政府各部门:
  《新乡市科技成果转化项目及资金管理办法》已经2006年6月5日市政府第36次常务会议研究,现予印发,望遵照执行。

  新乡市科技成果转化项目及资金管理办法


  第一章总则
  第一条为促进高新科技成果和农业科技成果转化,提高科技创新能力,培育和壮大具有自主知识产权的高新技术产业,规范新乡市科技成果转化专项资金的使用和管理,根据国家有关法律和政策规定,制定本办法。
  第二条本办法所称科技成果转化项目(以下简称“转化项目”)包括高新科技成果转化项目和农业科技成果转化项目。主要是指已取得的具有自主知识产权的科技成果进入中试到产业化前期,经过短期培育能实现产业化的项目。
  本办法所称科技成果转化资金(以下简称“转化资金”)是经市政府批准设立的支持高新科技成果和农业科技成果转化的专项资金。
  第三条市科技局是转化资金的项目主管部门,市财政局是转化资金的财务监管部门。
  第四条转化资金的使用和管理应遵守国家有关法律、法规、规章和政策规定,遵循诚实申请、择优支持、政府引导、注重效益、专款专用的原则。
  第二章资金管理组织
  第五条市科技局负责转化项目的监督管理工作。主要职责是:
  (一)审定转化项目的年度支持重点和工作计划;
  (二)审定转化资金支持的项目;
  (三)联合市财政局下达转化项目计划及资金预算;
  (四)对转化项目的实施和完成情况进行监督、检查。
  第六条市财政局负责转化资金的监督管理工作。主要职责是:
  (一)负责年度预算安排;
  (二)参与审定转化资金支持的项目;
  (三)审定项目资金预算,会同市科技局下达项目计划及资金预算,并按时拨付项目经费;
  (四)对转化资金的使用情况进行监督、检查。
  第七条成立市科技成果转化资金管理办公室(以下称管理办公室),管理办公室由市科技局和市财政局有关人员组成,市科技局局长任办公室主任,市科技局、市财政局主管副局长担任副主任,办公室设在市科技局,具体负责转化资金的日常管理工作。
  管理办公室主要职责是:
  (一)研究拟定市转化资金年度支持重点和工作计划方案;(二)受理、审查、论证市转化项目,提出年度转化项目立项和经费计划意见,经批准后组织实施;
  (三)编制市转化资金的年度财务决算、项目统计、监理和资金使用效果的综合评估报告;
  (四)受理国家、省转化项目申请,进行程序性审查,组织专家评估,完成推荐初评工作意见。
  第八条设立科技成果转化项目评审专家库,在集中评审时,由管理办公室按产业领域组织成立专家评审委员会,负责转化项目的专家评审工作。
  第三章资金来源、用途、支持方向与范围
  第九条转化资金每年从市财政科技经费中安排,列入年度财政预算,专款专用。
  第十条转化资金主要用于:
  (一)对列入市转化项目的资金支持;
  (二)对列入国家和省转化项目的配套支持;
  (三)用于支付转化项目评审等与管理转化资金工作有关的费用。
  第十一条高新科技成果转化资金主要支持对象是中小型高新技术企业,优先支持高校、转制科研院所的科技人员和留学归国人员创办的高新技术企业。范围主要包括电子信息、生物工程与医药、新材料、光机电一体化、装备制造、汽车零配件、新能源、节能及环境保护等高新技术领域的科技成果。
  第十二条农业科技成果转化资金主要支持对象是农业科技型企业(纯贸易企业除外)。范围主要包括有望达到批量生产和应用前景良好的农业新品种、新技术和新产品的区域试验与示范、中间试验或生产性实验,为农业生产大面积应用和工业化生产提供成熟配套的科技成果。
  科研机构和高校承担服务于农业、农村,以社会效益和生态效益为主,公益性强的转化项目,可视为农业科技型企业予以支持。
  第十三条鼓励产学研结合,鼓励科技成果的持有单位以技术入股等多种方式参与成果转化和市场竞争,鼓励科研机构和高校通过创办企业的方式申报转化项目。
  第十四条支持的转化项目应具备以下条件:
  (一)符合国家、省和市产业发展政策,有利于经济结构战略性调整,有利于改善生态环境;
  (二)技术含量高,创新性强,技术水平达到国内先进水平,具有自主知识产权或者属于引进、吸收但需中试扩大,以利于掌握其核心技术再创新的科技成果;
  (三)处于成果转化阶段,生产技术成熟,经省级以上科技管理部门或国家法定的行业认定机构鉴定、认定、审定、检测或用户认可(其中药品、农药、电子信息等需要行业许可证类的项目,须获得新药证书、生产许可证、市场准入资格等有关文件);
  (四)项目计划新增投资规模适中,资金来源基本确定,投资结构合理,项目实施期一般不超过两年;
  (五)产品附加值高,市场前景良好,产业带动性强,经济和社会效益显著,有望形成较大规模的新兴产业,有利于经济结构调整或经济社会的可持续发展。
  转化资金不支持已经成熟配套,并规模化应用的转化项目,不支持有知识产权纠纷的项目,不支持低水平重复建设的项目。
  第十五条转化项目承担单位应具备以下条件:
  (一)在新乡市境内注册,具备独立企业法人资格;
  (二)主要从事科技研究、开发、生产和服务的高新技术企业和农业科技型企业,具有较强的科技创新能力,或与省内外高校、科研机构有稳定的合作关系;
  (三)资产及经营状况良好,注册资金不少于50万元,资产负债率不超过60%,科技人员占职工总数的比例不低于30%,研发投入占销售收入比例为5%以上;
  (四)领导班子有较强的市场开拓能力和较高的经营管理水平,并有持续创新的科技意识;
  (五)拥有不低于申请转化资金的自有资金。
  第十六条转化项目采取贷款贴息和无偿资助两种方式支持。
  贷款贴息用于对高新科技成果转化项目的支持,申请项目应当是银行贷款已经到位。申请项目时需提供银行贷款合同书、贷款付息单等证件。
  无偿资助用于对高新科技成果和农业科技成果转化项目的支持,申请项目的自筹资金(含融资)不少于总投资的70%,申请项目时需提供有效的资金证明。
  每项资助经费额度一般为10—20万元。项目实施周期一般不超过两年。同等条件下,优先支持地方财政给予资金匹配的项目。
  第四章项目申请、审批与验收
  第十七条管理办公室每年向社会公开发布转化项目申报指南、年度支持重点及申报要求。
  第十八条申请单位可根据项目立项和进展情况随时进行申报。管理办公室每年组织两次集中评审,时间分别为每年的4月份和10月份。符合转化项目申请条件的单位,可按照管理办公室的要求上报申请材料。
  第十九条同一年度内,一个单位只能申请一个项目。已获得转化资金支持的单位,必须在已立项项目验收合格后,方可申请新项目。验收不合格的项目,原则上两年内承担单位不得申报新项目。
  已获市科技型中小企业技术创新专项资金扶持的项目不得再申请本专项资金。
  第二十条转化项目的申请:市属单位和企业通过市科技局直接申报,其他单位和企业通过所在县(市)、区科技主管部门提出申请,并提交以下材料:
  1.《新乡市高新科技成果转化项目申请书》或《新乡市农业科技成果转化项目申请书》;
  2.项目可行性研究报告或项目建议书;
  3.企业法人营业执照(复印件);
  4.经过有资质的中介机构审计的企业上年度会计报表,包括资产负债表、损益表、现金流量表以及报表附注等,并提供最近一个月的会计报表(复印件);
  5.企业与技术依托单位的合作协议;
  6.可以说明项目情况的证明材料(如鉴定证书、检测报告、查新报告、用户使用报告、专利证书等技术权益证明,生产许可证、销售合同等)以及企业有关资质证书。
  各县(市)、区科技部门应按照转化项目申报条件严格审查把关,对项目申报单位的资格、项目的先进性、真实性及转化可行性等进行审核,筛选出优秀项目并商同级财政部门,经财政部门对项目承担单位的财务管理水平和资金配套能力、项目资金预算的合理性及项目绩效目标的可行性进行审核后,共同签署推荐意见报送管理办公室。
  第二十一条管理办公室接受转化项目的申请后,组建专家评审委员会予以审核。评审专家应根据评审工作规范和审查标准,按照独立、审慎、公允的原则,对申请项目进行全面的审查,提出有针对性的审查意见。需要申请单位补充有关材料或作进一步说明的,应通过管理办公室提出,专家个人不得直接与申请单位和有关人员联系。必要时,可组织专家到申请单位进行审查。管理办公室根据专家委员会评审结果,进行集体研究和综合平衡,提出项目立项和经费计划意见报送市科技局与市财政局。
  第二十二条市科技局与市财政局将会签的项目立项和经费计划报主管副市长审批后,由市财政局、市科技局联合下达并向社会发布,接受社会监督。
  第二十三条市科技局与已批准立项的项目申请单位签订转化项目合同,作为拨款、检查和验收的依据。
  转化资金的拨付按财政国库管理制度的有关规定办理。经批准的项目预算一般不作调整,确有必要调整时,应按项目预算审批程序重新报批。
  第二十四条项目合同签订后,转化资金在合同签订后分两次拨付,立项后拨付70%,项目验收合格后再拨付其余资金。
  第二十五条因客观原因,项目承担单位需对转化项目的目标、进度和经费进行调整或撤消,必须提出书面申请,经审批后予以执行。
  第二十六条转化项目完成或者合同到期日一个月内,承担单位可向管理办公室提出项目验收申请,管理办公室组织对项目进行实地审查和验收。
  第二十七条项目验收严格按照签订的项目合同的规定进行。验收的内容包括合同计划进度执行情况、项目经济技术指标完成情况、项目研究开发取得的成果情况、资金落实与使用情况、项目实施后对企业整体发展的影响等。
  第二十八条项目验收分别两种情况作如下处理:
  (一)项目达到合同要求或初次验收不合格经限期整改后达到合同要求的,通过验收,全额拨付经费余额;
  (二)项目初次验收不合格,经限期整改后仍达不到合同要求的,作结题处理,且两年内不得再申报新的项目。
  第五章监督管理
  第二十九条转化资金只能用于以下开支,不得挪作他用:
  (一)人员费,指为直接参加转化项目实施的研发人员支出的劳务费用;
  (二)设备费,指项目实施中所必需的专用仪器、设备、软件及设备试制费;
  (三)技术服务及培训费,指项目实施过程中发生的科技咨询、技术指导、学术会议、技术培训等费用;
  (四)其他相关费用,指除上述费用之外与实施项目直接关联并经市财政部门认可的其他费用。
  第三十条管理办公室对项目承担单位的有关资金是否到位、资金使用是否符合规定用途、合同计划进度执行以及项目完成质量等情况进行监督检查。
  第三十一条承担转化项目的单位应自觉接受有关部门对项目实施过程的监督管理和检查,并向管理办公室定期报送项目信息监督调查表以及相关附件,管理办公室应认真审查有关材料,必要时可作实地考察。
  第三十二条管理办公室根据项目信息监督调查表和实地考察的结果,对合同提出继续执行、调整或者终止执行等处理建议。
  第三十三条项目推荐部门负责对所推荐项目的跟踪管理工作,帮助协调解决项目实施中遇到的问题,监督检查经费使用情况,并及时报告项目实施中的重大事项。
  第三十四条项目承担单位应严格执行国家有关财经法规、财务规章制度,认真履行合同,科学、合理、有效地安排和使用转化资金,保证专款专用。转化资金、配套资金与自筹资金等应实行统一管理和专账核算。
  第三十五条转化资金形成的资产(包括固定资产、无形资产和知识产权等)按国家有关规定进行管理;已完成并通过验收的项目结余经费,用于补助实施单位科研支出。
  第三十六条凡经被撤销或终止合同的转化项目,承担单位应按照项目的有关程序报经批准,将结余资金按原渠道归还,严禁非法转移、挪用、私分;已形成的资产应按照国家有关规定处置。
  第三十七条建立转化项目的考评和奖惩机制。对项目实施的考评结果将与项目承担单位以后年度申报、各县(市)、区和市直主管部门推荐项目挂钩。
  第三十八条对在项目申请、立项、实施、管理中有弄虚作假、挪用经费行为的或者在项目执行中严重违反有关规定或合同约定的,将采取通报、停止拨款、追回项目资金等相应处理措施,且有关单位两年内不得申报;国家财经纪律、财务制度有规定的,依据国家有关规定予以处理。
  第三十九条转化资金管理人员在受理、评审、管理活动中弄虚作假、以权谋私的,或者由于玩忽职守而造成转化资金流失或其他损失的,由有关主管机关或者所在单位给予行政处分;构成犯罪的,移送司法机关依法追究刑事责任。
  第六章附则
  第四十条本办法由市科技局会同市财政局负责解释。
  第四十一条本办法自发布之日起施行。

 PART II SECURITIES AND FUTURES COMMISSION

  There is hereby established a body to be known as the Securities 
and
  res Commission.
  The Commission shall be a body corporate with power to sue 
and be
  . (3) The receipts of the Commission shall not be subject to
taxation
  r the Inland Revenue Ordinance (Cap. 112).
  (a) The Commission shall provide itself with a seal.
  The seal of the Commission shall be authenticated by the signature 
of
  chairman or deputy chairman of the Commission or, if both the

  deputy chairman of the Commission are absent from Hong Kong or

  ct, the signature of some other director of the Commission 
authorized
  t to act in that behalf.
  
  unctions of Commission
  The Commission shall have the following functions--
  to advise the Financial Secretary on all matters 
relating to
  rities, futures contracts and property investment arrangements;
  without prejudice to any duties imposed or powers conferred 
on any
  r person in regard to the enforcement of the law 
relating to
  rities, futures contracts and property investment arrangements,
to be
  onsible for ensuring that the provisions of the relevant 
Ordinances,
  the provisions of any other Ordinance so far as they 
relate to
  rities, futures contracts and property investment 
arrangements, are
  lied with;
  to report to the Financial Secretary the occurrence of any dealing 
in
  tion to securities which it reasonably believes or suspects to 
be an
  der dealing within the meaning of section 9 of the Securities
(Insider

  to be responsible for supervising and monitoring the activities
of the

  to take all reasonable steps to safeguard the interests of 
persons
  ing in securities or trading in futures contracts or entering

  to promote and encourage proper conduct amongst members 
of the
  ange Companies and clearing houses, and other registered persons;
  to suppress illegal, dishonourable and improper practices in 
dealing
  ecurities, trading in futures contracts, entering into 
property
  stment arrangements, and the provision of investment advice or 
other
  ices relating to securities, futures contracts and property
investment
  ngements;
  to promote and maintain the integrity of registered 
persons and
  urage the promulgation by registered persons of balanced and 
informed
  ce to their clients and to the public generally;
  to consider and suggest reforms of the law relating to 
securities,
  res contracts and property investment arrangements;
  to encourage the development of securities and futures markets
in Hong
  and the increased use of such markets by investors in Hong Kong 
and
  where; (k) to promote and develop self-regulation by market
bodies in
  securities and futures industries;
  subject to the provisions of this Ordinance, to co-operate with 
and
  st authorities or regulatory organizations, in Hong Kong or
elsewhere,
  are concerned with securities and futures, or with banking,
insurance
  ther financial services or with the affairs of corporations;

  As regards any function, the Commission may, for the 
guidance of
  stered persons and others, prepare and cause to be published in 
the
  tte guidelines indicating the manner in which, in the absence of 
any
  icular consideration or circumstance, it proposes to 
perform the

  The Commission may from time to time engage such 
consultants or
  sers as it may consider necessary to assist the Commission 
in the

  Subject to subsection (2), the Commission shall consist of a 
chairman
  inted by the Governor and such uneven number, not being less than

  ther directors so appointed as the Governor may determine; and 
when
  number of such other directors ceases to be an uneven 
number the
  rnor shall make such appointment or appointments as may be 
necessary
  omply with this subsection.
  Half of the directors of the Commission, including the chairman,
shall
  ppointed to be executive directors and the remainder 
shall be
  inted to be non-executive directors.
  The Governor may appoint an executive director to be deputy 
chairman
  he Commission.
  (a) If no appointment has been made under subsection (3) or if 
the
  ce of deputy chairman of the Commission is vacant, the 
Financial
  etary may designate an executive director to act as chairman of 
the
  ission during any period during which the chairman of the 
Commission
  nable to act as chairman due to illness or other incapacity 
or is
  nt from Hong Kong.
  A designation under this subsection shall cease when revoked 
by the
  ncial Secretary or an appointment is made under 
subsection (3),
  hever first occurs. (5) The terms and conditions of office 
of a
  ctor of the Commission shall be such as the Governor may
determine.
  A director of the Commission may at any time resign his 
office by
  er sent to the Governor.
  A director of the Commission shall be paid by the Commission 
such
  neration, allowances or expenses as the Governor may determine.
  The Governor may by notice in writing remove from office any 
director
  he Commission whose removal appears to him to be desirable 
for the
  ctive performance by the Commission of its functions.
  Meetings of the Commission shall be held as often as may be 
necessary
  the performance of its functions, and may be convened by the 
chairman
  he deputy chairman or any 2 other directors.
  If the office of chairman of the Commission is vacant or the
chairman
  he Commission is unable to act as chairman due to illness or 
other
  pacity or is absent from Hong Kong the deputy chairman or an
executive
  ctor designated under subsection (4) shall act as chairman 
in his
  e.
  At a meeting of the Commission--
  the chairman shall be chairman of the meeting; or
  if the chairman is not present, the deputy chairman shall be 
chairman
  he meeting; or
  if neither the chairman nor the deputy chairman is 
present, the
  ctors present shall choose one of their number to be chairman of 
the
  ing.
  The quorum for a meeting of the Commission shall be 4 directors 
of
  2 shall be executive directors and 2 shall be non-
executive
  ctors.
  Each director of the Commission present at a meeting thereof 
shall
  a vote. (14) (a) Every question for decision at a meeting of 
the
  ission shall be determined by a majority of votes of the 
directors
  ent and, in the event that voting is equally divided, 
subject to
  graph (b) the chairman of the meeting shall have a casting vote. 
(b)
  chairman of a meeting shall not exercise a casting vote until
after he
  consulted the Financial Secretary as regards that exercise.
  The Commission may act notwithstanding a vacancy among its
directors.
  The Commission shall organize and regulate its 
administration,
  edure and business.

  The Commission may establish standing or special committees 
and may
  r or assign to any such committee any matter for 
consideration,
  iry or management by the committee.
  The Commission may appoint any person to be a member of any 
committee
  blished under this section, whether that person is a director of 
the
  ission or not. (3) Any reference or assignment under 
subsection (1)
  every appointment under subsection (2) may be withdrawn or
revoked by
  Commission at any time, and no such reference or assignment 
shall
  ent the performance by the Commission of any of its functions.
  A committee established under this section may elect any 
of its
  ers to be chairman and may regulate its own procedure and 
business;
  in the exercise of its powers under this subsection such 
committee
  l be subject to and act in accordance with any direction given
to the
  ittee by the Commission for the purposes of this subsection.
  Meetings of a committee established under this section shall be 
held
  uch times and places as the chairman of that committee may,
subject to
  ection (4), determine.
  taff of Commission
  The Commission may from time to time employ persons who shall be 
paid
  remuneration and allowances and shall hold their employment on 
such
  r terms and conditions as the Commission shall determine.
  The Commission may make arrangements for or in respect 
of the
  ision and maintenance of such schemes (whether contributory or 
not)
  the payment to its employees and their dependants of such

中华人民共和国和波兰人民共和国关于民事和刑事司法协助的协定


(注:本规定于1988年2月13日正式生效。
波兰共和国成立后继承了本协定。)

常务委员会第二十二次会议批准)
  中华人民共和国和波兰人民共和国,在尊重国家主权、独立、平等和互惠的基础上,为加强两国在司法领域的友好合作关系,决定缔结本协定。为此目的,特议定下列各条:

              第一章 总则

  第一条 司法保护
  缔约一方的国民在缔约另一方境内,享有与缔约另一方国民同等的司法保护,有权在与缔约另一方国民同等的条件下,在缔约另一方法院或其他机关进行诉讼或提出请求。

  第二条 诉讼费用保证金的免除
  缔约一方的法院和主管民事案件其他机关,对于在缔约另一方境内有住所或居所的缔约另一方国民,不得令其提供民事诉讼费用保证金。

  第三条 诉讼费用的预付
  缔约一方的国民在缔约另一方境内,应在与缔约另一方国民同等的条件下和范围内预付民事诉讼费用。

  第四条 法人
  前三条规定亦适用于法人。

  第五条 诉讼费用的减免
  缔约一方的国民在缔约另一方境内,可在与缔约另一方国民同等的条件下和范围内申请减交或免交民事诉讼费用。缔约一方的国民申请减免民事诉讼费用,应由其住所或居所所在地的主管机关出具证明书;如果该申请人在缔约双方境内均无住所或居所,亦可由其本国的外交或领事机关出具证明书。

  第六条 司法协助的途径
  一、缔约双方的法院和其他机关相互提供司法协助,由缔约双方的中央机关直接通知。
  二、前款所述的中央机关由缔约双方通过外交途径指明。

  第七条 司法协助请求书
  一、申请司法协助应用请求书。司法协助请求书的内容应包括下列各项:请求和被请求机关的名称,当事人的姓名、国籍、职业、住所或居所,代理人的姓名和地址,请求提供司法协助的具体案由。执行该请求所必需的其他文件和资料也须随请求书一并提供。
  二、请求刑事司法协助,应附该项请求涉及的犯罪事实的说明以及有关的法律规定。
  三、上述请求书和文件应由缔约一方的请求机关签署和盖章。

  第八条 语文
  司法协助范围内来往的信件和递送的文件应用本国的文字书写,并附有对方的文字或英文的译文。

  第九条 司法协助的费用
  一、缔约双方应相互免费提供司法协助。
  二、被通知到提出请求的缔约一方境内出庭的证人或鉴定人的旅费和食宿费,由提出请求的缔约一方承担。应本人要求,提出请求的缔约一方的主管机关应预付上述费用。

  第十条 司法协助的拒绝
  如果被请求的缔约一方认为提供司法协助有损于本国的主权、安全或公共秩序,可以拒绝提供司法协助,但应将拒绝的理由通知提出请求的缔约一方。

  第十一条 司法协助适用的法律
  一、被请求机关提供司法协助,适用本国法律。
  二、被请求机关提供民事司法协助,亦可应请求适用缔约另一方的法律,但以不违背被请求的缔约一方法律的基本原则为限。

  第十二条 定义
  本协定中所指“民事案件”,也包括商法、婚姻法和劳动法等范围内有关财产权益和人身权利的案件。

        第二章 民事方面的送达文书和调查取证

  第十三条 范围
  缔约双方应根据请求相互代为送达司法文书和司法外文书,询问当事人、证人和鉴定人,进行鉴定和司法勘验,以及收集其他证据。

  第十四条 请求的执行
  一、如果被请求的缔约一方的机关认为自己无权执行请求,则应将该项请求转送有权执行请求的主管机关,并通知请求机关。
  二、被请求的缔约一方的机关如果无法按照请求书中所示的地址执行请求,应采取适当措施以确定准确的地址,完成请求事项,必要时可要求提出请求的缔约一方提供补充的情况。
  三、如因无法确定地址或其他原因不能执行请求,被请求的缔约一方的机关应通知提出请求的缔约一方,说明具体原因,并退回提出请求的缔约一方所附的文件。

  第十五条 通知执行情况
  一、被请求的缔约一方的主管机关,应按照本协定第六条第一款规定的途径,将送达文书或调查取证的执行日期和地点通知提出请求的缔约一方的主管机关,并附送达回证或所得的证据材料。
  二、送达回证应注明收件人收件日期和签名,送达机关和送达人的盖章和签名。如收件人拒收文件,应注明拒收的事由。

          第三章 民事裁决的承认与执行

  第十六条 范围
  一、缔约双方应根据本协定规定的条件,在其境内承认或执行本协定生效后的缔约另一方境内作出的下列裁决:
  (一)法院对民事案件作出的裁决;
  (二)法院对刑事案件中有关赔偿请求所作出的裁决;
  (三)主管机关对继承案件作出的裁决;
  (四)仲裁庭作出的裁决。
  二、本协定中所指“裁决”也包括调解书。

  第十七条 请求应附的文件
  请求承认与执行裁决,应附下列文件。
  (一)与原本相符的裁决副本。如果副本中没有明确指出裁决已经生效和可以执行,则应附由法院出具的证明其已生效和可以执行的文件;
  (二)送达回证或证明裁决已经送达的其他文件;
  (三)法院证明败诉一方已经合法传唤,以及在其缺乏诉讼行为能力时已得到应有代理的文件;
  (四)请求书和前三项所指文件经证明无误的被请求的缔约一方文字或英文的译文。

  第十八条 承认与执行的程序
  一、承认或执行裁决的请求,可由缔约一方法院依照本协定第六条第一款规定的途径向缔约另一方法院提出,亦可由当事人直接向将承认或执行裁决的缔约另一方有管辖权的法院提出。
  二、在承认与执行裁决的程序中,法院只审查该裁决是否符合本协定所规定的条件。

  第十九条 承认与执行的效力
  缔约一方的裁决一经缔约另一方法院承认或执行,即与承认或执行裁决一方的法院作出的裁决具有同等效力。

  第二十条 拒绝承认与执行
  对本协定第十六条列举的裁决,有下列情形之一的,不予承认或执行:
  (一)按照将承认或执行裁决的缔约一方的法律,裁决是由无管辖权的法院作出的;
  (二)根据作出裁决的缔约一方的法律,该裁决尚未生效或不能执行;
  (三)根据作出裁决的缔约一方的法律,败诉一方当事人未经法院合法传唤;
  (四)当事人被剥夺了答辩的可能性,或在缺乏诉讼行为能力时被剥夺了应有的代理;
  (五)将承认或执行裁决的缔约一方境内的法院对于相同当事人之间就同一诉讼标的的案件已经作出了发生法律效力的裁决,或正在进行审理,或已承认了第三国法院对该案所作的发生法律效力的裁决;
  (六)裁决的承认或执行有损于将承认或执行裁决的缔约一方法律的基本原则或公共秩序。

  第二十一条 仲裁庭裁决的承认与执行
  缔约双方应根据1958年6月10日在纽约签订的关于承认和执行外国仲裁裁决的公约,相互承认与执行在对方境内作出的仲裁裁决。

        第四章 刑事方面的送达文书和调查取证

  第二十二条 范围
  缔约双方应根据请求,在刑事方面相互代为送达司法文书和司法外文书,听取当事人、嫌疑犯的陈述,询问证人、被害人和鉴定人,进行鉴定、检查和司法勘验,以及收集其他证据。

  第二十三条 请求的执行和通知执行情况
  本协定第十四条、第十五条的规定亦适用于刑事方面的送达文书和调查取证。

  第二十四条 刑事司法协助的拒绝
  被请求的缔约一方可根据下列理由之一拒绝提供刑事司法协助:
  (一)如果被请求的缔约一方认为该项请求涉及的犯罪具有政治性质或为军事犯罪;
  (二)按照被请求的缔约一方的法律,该项请求涉及的行为并不构成犯罪;
  (三)该项请求涉及的嫌疑犯或罪犯是被请求的缔约一方国民,且不在提出请求的缔约一方境内。

  第二十五条 刑事诉讼结果的通知
  缔约双方应相互递送各自法院对缔约另一方国民所作的生效裁决的副本或案情摘要。

             第五章 其他规定

  第二十六条 交流法律情报
  缔约双方应根据请求,按照本协定第六条第一款规定的途径相互提供本国有关的法律和司法实践的情报,交换法学出版物。

  第二十七条 认证的免除
  由缔约一方法院或其他主管机关制作或证明的并加盖印章的文件,不必经过认证,即可在缔约另一方境内使用。

  第二十八条 证人和鉴定人的保护
  一、对通过被请求的缔约一方通知前来出庭的证人或鉴定人,无论其国籍如何,提出请求的缔约一方不得因其入境前所犯的罪行或者因其证词、鉴定或其他涉及诉讼内容的行为而追究其刑事责任和以任何形式剥夺其自由。
  二、如果证人或鉴定人在接到无须继续留在提出请求的缔约一方境内的通知后次日起15日内,有出境的可能而仍不出境的,即丧失前款给予的保护。

  第二十九条 协定的执行
  本协定执行过程中所产生的任何困难均应通过外交途径解决。

             第六章 最后条款

  第三十条 批准和生效
  本协定须经批准,批准书在北京互换。本协定自互换批准书之日起第30天开始生效。

  第三十一条 终止
  缔约任何一方可书面通知另一方要求终止本协定。本协定在发出终止通知之日起12个月后失效,否则本协定永远有效。
  本协定于1987年6月5日在华沙签订,一式两份,每份用中文和波兰文写出,两种文本具有同等效力。
  缔约双方全权代表分别在本协定上签字盖章,以昭信守。
